Edwards Water Resources, LLC charges a fee of 5% of the total consideration of any water rights lease transaction, based on the total consideration due to the Seller. All fees due Texas Water Resources, LLC are paid from the OWNER of the Water Rights (i.e. the party leasing the water TO the tenant farmer or temporary user, unless otherwise specifically negotiated) and are due within 30-days of the receipt of the lease proceeds. Owner will warrant that there are no liens on the water rights at the time of lease or could face appropriate legal consequences.
Example: Let's say you own 150 Acre Feet of 'Unrestricted' Edwards Aquifer water rights and want to lease them to a user for a period of three (3) years. We then go out on our network and database and attempt to find you the "best bid" that fits these needs. We then present it to you for your approval. In this example let's say we were able to find a 'tenant' for the 150 acre feet at a rate of $60 per acre feet per year.
The GROSS amount due to you would be the rate x number of Acre Feet x Years or $60.00 x 150 x 3 years = $27,000
Edwards Water Resources, LLC's fee is 5.0 of the total consideration or: $27,000 x .05 = $1,350.00
Therefore the NET due to the Seller (in this example) would be: $27,000 - $1,350.00 = $25,650
